In Liebeck v. McDonald's Restaurants (1994) we learn the Hot Coffee can be hazardous at temperatures in the range of 180–190 °F (82–88 °C). In McMahon v. Bunn Matic Corporation (1998), we know that coffee at 179 °F (82 °C) is not "unreasonably dangerous".
Based upon your premise I will presume that the coffee under consideration is at least 180 °F thereby qualifying it as useful as a hazardous material.
In the State of Minnesota v National Tea Company (1940) we learned that the 14th Amendment applied to the taxation of interstate sales of unsweetened tea was correlated to the tax applicable to altered water, or in this case "dirty water" for purposed of determining the applicable sales tax rate.
So, coffee has a use and unsweetened tea is essentially just dirty water.
I vote with the majority in favor of the verdict.
