Hey,
When shards first became available, i went to the Upgrades and bought Upgrade #1, but it didn't apply.

You have to play in a game with boost & upgrades enable (last icon on the right, a little shield and a lightening strike.

I did read the FAQ. I brought it up because I was playing an opponent who was getting the 30 men and I was not.
This was happening again just now. I was getting 20 and he was getting 30

No, it still says its available to buy.
